These Terms of Use ("Terms") form a legal agreement between you and Osprey Applications LLC ("Osprey," "we," "us," or "our") governing your use of the Flashing Light: Morse Trainer application (the "App"). Please read them carefully.
Training tool only. Flashing Light: Morse Trainer is a practice and study aid. It is not affiliated with or endorsed by the U.S. Coast Guard or any government agency, is not a substitute for official examination or certification, and must never be relied upon for operational or safety-of-life signaling.
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not download, install, or use the App. Your continued use of the App after we post updated Terms constitutes your acceptance of those changes.
2. License Grant
Subject to these Terms, Osprey grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App and its bundled content on Apple devices you own or control, solely for your own personal, non-commercial training and study. The App and its bundled content are licensed, not sold, to you.
You may not copy, modify, reverse engineer, decompile, disassemble, redistribute, rent, lease, sublicense, or create derivative works from the App or its content, except to the extent such restrictions are prohibited by applicable law.
3. In-App Purchase and Payments
The App is free to download. A single one-time, non-consumable in-app purchase called "Full Access" ($9.99 USD, or the Apple-equivalent price in your region) unlocks additional features. This is a one-time purchase — not a subscription and not a recurring charge.
- Full Access is sold and processed by Apple through StoreKit and is subject to Apple's Media Services Terms and Conditions and applicable Apple terms.
- Full Access is Family Sharing-eligible and persists across reinstalls and devices signed in to the same Apple ID. A "Restore purchase" option is provided.
- All payments are handled by Apple. We never receive your payment method, billing address, or other identifying payment details.
4. Refunds
All purchases are processed by Apple, and refunds are handled solely by Apple under Apple's standard policies. Osprey cannot issue, approve, or deny App Store refunds. To request a refund, contact Apple Support.
5. Acceptable Use
You agree to use the App only for its intended purpose — personal training and study — and in compliance with all applicable laws. You agree not to interfere with or disrupt the App, attempt to gain unauthorized access to any systems, or use the App in any unlawful or harmful manner.
6. Intellectual Property
Morse code, the International Code of Signals, and PUB 102 are public-domain reference standards. The App reproduces this factual reference material on a public-domain basis; we claim no ownership over the underlying standards themselves.
However, the App as a whole — including its software, source code, user interface, design, layout, drills, curated and structured content, databases, and the selection, arrangement, and presentation of all reference material — is © 2026 Osprey Applications LLC and is protected by copyright and other intellectual-property laws. All rights not expressly granted to you in these Terms are reserved by Osprey. "Osprey Applications" and "Flashing Light: Morse Trainer" are marks of Osprey Applications LLC.
7. Training-Tool Disclaimer
Flashing Light: Morse Trainer is an independent practice and study aid intended to help you prepare for U.S. Coast Guard flashing-light (signal-lamp) Morse competency. It is not affiliated with, endorsed by, or sponsored by the U.S. Coast Guard, the U.S. Navy, or any government agency, and it does not reproduce any single official Coast Guard testing interface.
- The App is not a substitute for official USCG examination, an approved course, or any credentialing or certification program. Passing in-app drills or the Mock Exam does not guarantee any real-world examination result or certification.
- Safety-of-life disclaimer: The App is for training only. It must not be used or relied upon for actual operational, navigational, distress, or safety-of-life signaling or communication, and is not operational signaling equipment.
- We make no warranty that any reference content (including PUB 102 / International Code of Signals material) is current, complete, or error-free, or that the App's timing, scoring, or feedback is accurate for any operational use.
8. Photosensitivity Warning
The App deliberately flashes bright light to simulate signal-lamp Morse and may not be suitable for users with photosensitive epilepsy or other photosensitivity. The App displays a photosensitivity warning on first launch and provides reduced-motion, lower-intensity lamp, and symbolic-only modes. You accept responsibility for using these safety modes as needed and, if you have photosensitive epilepsy or any related condition, for consulting a medical professional before use.
9. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected. To the fullest extent permitted by law, you use the App at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, Osprey Applications LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, training outcomes, exam performance, or certification, arising out of or relating to your use of or inability to use the App, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability shall not exceed the amount you paid for the App, if any.
11. Apple as Third-Party Beneficiary
Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as a third-party beneficiary, consistent with Apple's standard Licensed Application requirements.
12. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the App after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State in which Osprey Applications LLC is organized, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction and venue of the courts located in that jurisdiction for any dispute arising out of or relating to these Terms or the App, except where prohibited by applicable law.
